Gerard Malouf
A successful and groundbreaking medical negligence case that Gerard worked on, was the infamous “Chelmsford Deep Sleep therapy” case, that received both National and international media attention. A case, which the NSW Health Minister of the time described as “the darkest episode of the history of psychiatry in this country”, involved a Dr Harry Bailey, a psychiatrist at Pennant Hill’s Chelmsford private hospital. In 1963, Dr Bailey began to administer what is called, deep sedation therapy or deep sleep therapy.

Bailey’s technique for handling mentally disturbed Chelmsford patients, who were sent to him for help and care, was essentially simple. If heavy-handed, he would place them in a coma for up to two weeks, during which period he would administer daily doses of electroshock therapy and/or psychosurgery, often without the consent or knowledge of the “sleeping” patient.

His Autocratic reign ran from 1963 to 1979 by which stages hundreds of patients had died and some committed suicide. Surviving victims suffered severe psychological and emotional trauma for the next 30 years, when the case finally came to light. With the assistance of council, Gerard helped clarify the laws in relation to limitation actions, that is, actions brought outside the standard limitation periods applicable at the time.

The doctor in question was never prosecuted since he committed suicide in 1985, using the same drugs he had been feeding his patients. After ten years of persistent investigation, surviving victims received compensation in excess of $300,000 each.



Vrege Kolokossian
One of the success stories that Vrege is responsible for has to do with an elderly gentleman, who was involved in a Motor Vehicle Accident. The client initially approached his Insurer to determine what level of financial compensation he could receive. The insurer’s response was an amount of $1000 and handed the client a form to sign that would say he was accepting that amount only. The client had no understanding of what he was legally entitled to and ‘trusted’ that his insurance company were being faithful to him. Even though he accepted that this must be all he was entitled to, he thought he would check this out with a lawyer before signing on the dotted line.

That’s when he came to see Vrege, who advised him that the insurers offer was in no way acceptable and he referred him to be assessed by an Independent Medical Assessor. The assessor’s results found that the client was eligible for an amount that far exceeded the original offer made by his insurer.

Vrege fought on behalf of the client, resulting in a win of $60,000 in compensation and was also entitled to receive paid handyman assistance care due to his age and injuries.

Vrege was satisfied that a client, who was unfamiliar with his rights, ended up receiving what he truly was entitled to.
